Terms and Conditions
Effective Date: December 1st, 2025
Electronic Communication Consent
By providing your email address and signing up to receive communications, you consent to receive electronic messages from the Seller, including newsletters, promotional offers, account updates, transactional notifications, and other information related to the Seller’s products and services. You agree that these communications may be sent via email and may include marketing content.
You may withdraw your consent at any time by clicking the “unsubscribe” link included in any email or by contacting the Seller directly using the contact information provided on the website. Withdrawal of consent will not affect the legality of any communications sent before your request is processed.
The Seller will handle your personal information in accordance with its Privacy Policy and applicable data protection laws. Standard data or message rates may apply depending on your service provider.
Copyright Ownership
All artwork sold on this website, including but not limited to paintings, prints, drawings, digital artwork, photographs, and any other creative works (collectively referred to as "Artwork"), remains the intellectual property of Terrain Paper (the "Seller"). The Buyer acknowledges and agrees that the purchase of any Artwork does not transfer copyright or any other intellectual property rights to the Buyer. The copyright in all Artwork is retained solely by the Seller.
Digital Artworks
For digital artwork (such as downloadable files, digital prints, and artwork created for online or screen-based use), the following terms apply:
The Buyer is granted a limited, non-exclusive, non-transferable license to download and display the digital artwork for personal, non-commercial purposes only.
The Buyer may print the digital artwork for personal use (such as home décor), but the Buyer is not permitted to resell, redistribute, or reproduce the digital artwork in any form for commercial use without obtaining a separate license from the Seller.
License to Use (Physical Artwork)
When purchasing physical Artwork (such as paintings, or prints), the Buyer is granted a limited, non-exclusive, non-transferable license to display the Artwork in a private setting for personal, non-commercial purposes only. The Buyer is not authorized to reproduce, alter, or create derivative works based on the Artwork without explicit, written permission from the Seller.
Commercial Use Prohibited
The Buyer agrees not to use the Artwork in any commercial manner without prior written consent from the Seller. This includes, but is not limited to:
Reproducing the Artwork for resale (e.g., selling prints, merchandise, or other copies of the Artwork).
Using the Artwork in marketing, advertising, or product packaging.
Creating digital copies, products, or promotional materials using the Artwork.
Digital Art Reproduction and Modification
The Buyer does not have the right to:
Reproduce, alter, or modify the digital artwork in any way (including using the artwork in social media posts or as digital designs for products) without the express written consent of the Seller.
Create derivative works based on the digital artwork, including but not limited to adaptations, transformations, or new works based on the original.
Limited Editions
The Buyer does not have the right to reproduce, sell, or distribute additional copies of the limited edition, nor do they have the right to create derivative works based on the limited edition Artwork.
Infringement of Copyright
The Buyer acknowledges that any unauthorized use of the Artwork, including reproduction, distribution, or sale of copies of the Artwork without the Seller's consent, constitutes copyright infringement and is subject to legal action. The Seller reserves the right to pursue legal remedies for infringement, including claims for damages, attorney’s fees, and injunctive relief.
Transfer of Ownership (Physical Artwork)
Upon purchase of a physical Artwork (print or original), the ownership of the physical piece is transferred to the Buyer. However, ownership of the physical Artwork does not imply ownership of the copyright or any other intellectual property rights associated with the Artwork. The Seller retains full ownership of the copyright, including any rights to create reproductions, digital versions, or other derivative works.
Transfer of Ownership (Digital Artwork)
When purchasing digital Artwork, the Buyer receives a non-exclusive, non-transferable license to use and display the digital file for personal use only. The Buyer does not own the copyright in the digital file, and any commercial use or reproduction of the digital file requires a separate license agreement from the Seller.
Licensing for Commercial Use
In the event that the Buyer wishes to use the Artwork for commercial purposes (such as reproducing the Artwork for sale, creating products, or using it in a business), the Buyer must negotiate and obtain a separate license agreement from the Seller. Such a license will specify the terms, scope, and compensation for commercial use.
Please email us at license@terrainpaper.com for obtaining a license agreement to use for Commercial Use.
Termination of License
The license granted to the Buyer to display the Artwork (whether physical or digital) may be terminated by the Seller if the Buyer breaches any terms of this Copyright and Ownership Clause, including unauthorized use or reproduction of the Artwork. Upon termination of the license, the Buyer will immediately cease all use of the Artwork and will return or destroy any reproductions or copies of the Artwork.
Limitation of Liability
To the fullest extent permitted by applicable law, the Seller shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or related to the purchase, production, shipment, or use of any print-on-demand Artwork. Because print-on-demand items are manufactured by third-party providers, the Seller is not responsible for manufacturing delays, printing variations, or shipment issues outside the Seller’s reasonable control.
The Buyer acknowledges that minor variations in color, cropping, or material quality may occur due to the nature of print-on-demand production and differences in display screens, and such variations shall not constitute defects. In no event shall the Seller’s total liability exceed the amount actually paid by the Buyer for the specific item giving rise to the claim. Any claim must be submitted within 30 days of purchase.
Nothing in this clause shall limit or exclude liability where such limitation is prohibited by law, including mandatory consumer rights in the Buyer’s jurisdiction.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law principles. The parties agree that any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state or federal courts located in Baltimore County, Maryland, United States, and the parties hereby consent to the personal jurisdiction and venue of such courts.
If any dispute arises in connection with this Agreement, the parties agree to first attempt to resolve the dispute through informal negotiations. If the dispute is not resolved within 30 days, either party may seek resolution through the courts in the jurisdiction specified above.
Termination Rights
Seller’s Right to Terminate
The Seller reserves the right to terminate the sale or agreement at any time, with or without cause, before the Artwork has been shipped or delivered to the Buyer. Reasons for termination may include, but are not limited to:
Non-payment or failure to meet payment terms.
Inaccurate or fraudulent information provided by the Buyer.
Issues related to the availability of the Artwork.
Violation of the Seller’s terms and conditions.
In the event of such termination, the Seller will notify the Buyer in writing (via email or other appropriate communication), and any funds paid by the Buyer will be refunded within a reasonable time period, unless otherwise specified in this agreement.
Buyer’s Right to Terminate
The Buyer may terminate the purchase agreement only under the following circumstances:
If the Artwork is damaged during shipping or does not conform to the description provided by the Seller at the time of sale (subject to the return/refund policy).
If the Buyer has not received the Artwork within the expected delivery time frame and no resolution has been reached with the Seller.
To exercise the right of termination, the Buyer must notify the Seller within 7 days after the date of delivery of the Artwork (or the expected delivery date). Upon receipt of the Buyer’s termination notice, the Seller will arrange for the return of the Artwork and issue a refund according to the Return and Refund Policy.
Consequences of Termination
If the Seller terminates the agreement, the Buyer will be entitled to a full refund of any amount paid for the Artwork, excluding shipping and handling fees (if applicable), provided that the Artwork has not already been shipped.
If the Buyer terminates the agreement within the applicable return period, the Buyer will be entitled to a full refund of the purchase price, excluding any non-refundable shipping or handling fees. The Buyer will be responsible for returning the Artwork in its original, unused condition and will bear the cost of return shipping.
In the event of a breach of contract (e.g., failure to pay or violation of terms), the terminating party may be entitled to additional legal remedies, including damages for any losses incurred.
Termination for Force Majeure
Both the Seller and the Buyer may terminate this agreement in the event of circumstances beyond their control, including but not limited to natural disasters, strikes, acts of government, war, or other events of force majeure that make performance of the contract impossible. Neither party will be held liable for failure to perform their obligations during such events, and both parties agree to work in good faith to resolve any issues arising from force majeure events.
